Sam’s Cash Bonus Offers Program Terms and Conditions

I. Introduction

The Sam’s Cash Bonus Offers Program allows eligible Sam’s Club members to earn, in various ways, Sam’s Cash rewards currency (“Sam’s Cash”) that they can redeem pursuant to the Sam’s Cash Loyalty Rewards Program Terms and Conditions. The Sam’s Cash Bonus Offers Program allows an eligible member to link his or her valid, eligible credit or debit card (“Designated Payment Card”) to earn Sam’s Cash when completing qualifying activities (such as activating an offer and/or making a qualifying purchase) at certain third-party merchants. By linking a Designated Payment Card in the Sam’s Cash Bonus Offers Program, you acknowledge that you have read these terms and conditions, understand them, and agree to be bound by them.

Your participation in the Sam’s Cash Bonus Offers Program is subject to the Sam’s Cash Bonus Offers Program Terms and Conditions, the SamsClub.com Terms and Conditions, including the Clubs, Site and Membership Terms of Use, the Sam’s Cash Loyalty Rewards Program Terms and Conditions, the Sam’s Club Privacy Policy, the Sam’s Cash Bonus Offers Program Privacy Notice, and other Sam’s Club rules and policies, including the Sam’s Club® Mastercard® Terms and Conditions, as may be applicable. In addition, the Visa, Mastercard, and American Express payment card networks may impose restrictions, conditions, or limitations on your participation in the Sam’s Cash Bonus Offers Program.

All Sam’s Club rules, including these Sam’s Cash Bonus Offers Program Terms and Conditions, may be amended from time to time without notice.

II. Sam’s Club Membership and Other Requirements

To link a Designated Payment Card in the Sam’s Cash Bonus Offers Program, you must:

  • Have a current Sam’s Club membership;
  • Have a current SamsClub.com account;
  • Have a current email address;
  • Be a current resident of the United States, the District of Columbia, or Puerto Rico; and
  • Have added an eligible, valid, and unexpired Visa, Mastercard, or American Express credit or debit card that you are authorized to use in your SamsClub.com account as a form of payment; or
  • - Have used an eligible, valid, and unexpired Visa, Mastercard, or American Express credit or debit card that you are authorized to use when making a purchase at Sam’s Club in which participation in the Sam’s Cash Bonus Offers Program is offered (see “How to Participate,” below).

Not all Visa, Mastercard, and American Express cards are eligible for linking in the Sam’s Cash Bonus Offers Program. The following cards are not eligible for linking: Corporate cards and Purchasing cards from Visa, Mastercard, and American Express; non-reloadable prepaid cards; government-administered prepaid cards (including EBT cards); healthcare cards, including Health Savings Account and Flexible Spending Account or insurance prepaid cards; Visa Buxx; and Visa-, Mastercard-, American Express-branded cards whose transactions are not processed through the Visa U.S.A. payment system, Mastercard payment system, or American Express payment system, and the Apple Card issued by Goldman Sachs Bank USA. Visa, Mastercard, and American Express may choose to cease or limit their participation in the Sam’s Cash Bonus Offers Program at any time and without prior notice. If a payment card network ceases to participate or decides that a particular card will no longer participate, and you have linked that payment card network’s card(s) as a Designated Payment Card(s), such card(s) will be immediately unlinked and ineligible to qualify to earn Sam’s Cash.

If you link a debit card as your Designated Payment Card, in order to qualify for Sam’s Cash, you must process each of your qualifying purchases as a “credit” (that is, signature) transaction to ensure that the transaction may be monitored by the payment card network. (Please see “Earning Sam’s Cash,” below.) If you use a Personal Identification Number (“PIN”) when making a qualifying purchase with your Designated Payment Card, your purchase will not be eligible for Sam’s Cash.

Once you have consented to participate in the Sam’s Cash Bonus Offers Program and linked a Designated Payment Card, you may add additional eligible Designated Payment Cards to your program account. We use Figg, Inc. (“Figg”) as our service provider to help us operate the Sam’s Cash Bonus Offers Program. Each of your Designated Payment Cards may be linked in only one program operated by Figg. If you have already linked a Designated Payment Card in a separate program operated by Figg, you will be unable to link that card in the Sam’s Cash Bonus Offers Program, unless you deactivate that card in the other program before linking it in the Sam’s Cash Bonus Offers Program. You may also link a different eligible Designated Payment Card in the Sam’s Cash Bonus Offers Program.

III. How to Participate

If you are an eligible member, you may be able to participate in the Sam’s Cash Bonus Offers Program in one of the following ways, which are subject to availability and to change:

  1. Go to SamsClub.com/BonusOffers and follow the instructions to participate.
  2. Go to More and then Bonus Offers in the Sam’s Club mobile app and follow the instructions to participate.
  3. When you are in a physical Sam’s Club location and use the Scan & Go™ feature of the Sam’s Club mobile app, you may be offered the opportunity to participate in the Sam’s Cash Bonus Offers Program; follow the instructions to participate when you pay for your scanned items.
  4. When you are in a physical Sam’s Club location, you may be offered the opportunity to participate in the Sam’s Cash Bonus Offers Program at checkout.
  5. When you use a credit or debit card to purchase a Sam’s Club membership, either online on SamsClub.com or in person at the membership express desk located in a physical Sam’s Club location, you may be presented with the opportunity to participate in the Sam’s Cash Bonus Offers Program.
  6. All notices associated with the Sam’s Cash Bonus Offers Program will be sent to the email associated with your SamsClub.com account.

IV. Earning Sam’s Cash

A. General Terms

When you have consented to participate in the Sam’s Cash Bonus Offers Program and linked a Designated Payment Card, you may earn Sam’s Cash when completing qualifying activities (such as activating an offer and/or making a qualifying purchase with your Designated Payment Card) at certain participating third-party merchants, consistent with the terms of the offer. Offers, merchants, and qualifying activities may change from time to time without notice, and Sam’s Club is not liable for any such changes. You are responsible for confirming that a third-party merchant’s offer is available on the Sam’s Cash Bonus Offers Program platform, and thus eligible for you to earn Sam’s Cash, prior to transacting with the merchant. If an offer is not included as available on the Sam’s Cash Bonus Offers Program platform, then it is not eligible for earning Sam’s Cash. In addition, in order to earn Sam’s Cash for an otherwise qualifying transaction, the Designated Payment Card used for that transaction must remain linked to the platform long enough for that transaction to be fully processed by the payment processor (usually within 15 days).

If a participating third-party merchant, including without limitation, a service subscription provider or a restaurant, makes an offer, you must purchase directly from the merchant in order to earn Sam’s Cash in connection with that offer. This means, without limitation, that a purchase that you make through an App store (e.g., Apple’s App Store or the Google Play Store) will not qualify to earn Sam’s Cash for an offer from a service subscription provider; or a purchase that you make through a third-party delivery service (e.g., DoorDash, Grubhub, Uber Eats) will not qualify to earn Sam’s Cash for an offer from a restaurant. In addition, unless otherwise specified in the details for each offer, orders placed online directly from a restaurant will not qualify to earn Sam’s Cash. Finally, “tips” or “gratuities” are not eligible to earn Sam’s Cash and will not be included in the calculation of the amount of Sam’s Cash earned at restaurants or other merchants.

Merchants within certain categories may be excluded from the Sam’s Cash Bonus Offers Program at Sam’s Club sole discretion, and Sam’s Cash is not earned on purchases from merchants within these categories. Such excluded merchant categories may include, but are not limited to the following:

  • Alcoholic beverages
  • Financial Services
  • Insurance Products
  • Firearms
  • Gambling
  • Betting, including Lottery Tickets, Casino Gaming Chips, Off-Track Betting, and Wagers at Racetracks
  • Online/Internet Gambling
  • Dating or Escort Services
  • Massage Parlors
  • Internet Pharmacies
  • Merchants that have sale of adult or mature content products and services

Sam’s Club reserves the right to add, modify, or delete merchant categories without notice or liability to you.

Where prohibited or restricted by applicable law, Sam’s Cash is not earned on purchases of certain disqualified products, regardless of where or how any such product is purchased. For example, Sam’s Cash may not be earned on the purchase of alcoholic beverages, regardless of whether the alcoholic beverage is purchased from a retailer or restaurant. Sam’s Club reserves the right to add, modify, or delete qualifying restrictions on product categories or products without notice.

If you purchase a disqualified product, or purchase product from an excluded merchant, if Sam’s Club determines that applicable law prohibits or restricts a particular product, offer or transaction, or if Sam’s Club determines in its discretion that a particular product, offer or transaction is otherwise inappropriate or ineligible, Sam’s Club may, in its discretion, withdraw such offer, withdraw product within an offer, not award Sam’s Cash in connection with such product, offer or transaction, and/or deduct from your account Sam’s Cash already awarded in connection with such product, offer or transaction, all without notice or liability to you.

Refunds associated with qualifying transactions may affect eligibility for earning Sam’s Cash. Sam’s Cash earned from refunded or cancelled transactions may be withheld from payout or removed from your Sam’s Cash account.

By linking a Designated Payment Card in the Sam’s Cash Bonus Offers Program, you authorize Sam’s Club and its service providers, including Figg, to share your Designated Payment Card information with the relevant payment card network (i.e., Visa, Mastercard, or American Express). You agree that the payment card network may monitor and share data from transactions made with your Designated Payment Card(s) at participating third-party merchants with Sam’s Club and its third-party service providers, including Figg. You further agree that Sam’s Club, its third-party service providers (including Figg), and the payment card network may obtain, provide, and/or use your transaction data to determine whether you have qualified for Sam’s Cash, calculate your Sam’s Cash earned, enable card-linked offers, and facilitate the Sam’s Cash Bonus Offers Program in accordance with these Terms and Conditions, the Sam’s Club Privacy Policy, and the Sam’s Cash Bonus Offers Program Privacy Notice. Also, Sam’s Club, its third-party service providers (including Figg), and Visa may use transaction data from past purchases at participating or similar merchants on linked Visa cards to target offers that may be of interest to you. Sam’s Club may also share your transaction data with participating third-party merchants to determine if you are eligible to receive the offered Sam’s Cash. If you do not want your transaction data used and disclosed in these ways, you may unlink your Designated Payment Card(s) from your Sam’s Cash Bonus Offers Program account. For each Designated Payment Card that you want to unlink, follow the steps below:

  1. On the Sam’s Cash Bonus Offers Program website [samsclub.com/bonusoffers], click on Your Cards;
  2. Click on Unlink and confirm, when prompted, that you want to unlink the card from your account.
  3. You must repeat this process for every card you want to unlink.

Please note that the payment card network may not track all of your transactions using your Designated Payment Card. Specifically, you understand and agree that Visa, Mastercard, and American Express (as applicable) may be unable to monitor every transaction made with your Designated Payment Card, including, for example, PIN-based purchases, purchases you initiate through identification technology that substitutes for a PIN, payments made through other payment methods (such as a digital wallet or a third-party payment app, where you may choose your Designated Payment Card as a funding source but do not present your card directly to the merchant), payments of existing balances, balance transfers, or transactions that are not processed or submitted through the payment card network payment systems. All of these transactions are ineligible to earn Sam’s Cash.

In no event shall the applicable payment card network be considered as maintaining any type of financial obligation or deposit or other asset account or holding funds or other value for you for distribution to you. Any pending statement credit and any associated dollar values represent offer fulfillment amounts in process owed by the applicable merchant and not your funds or balances maintained or held by the payment card network or Sam’s Club.

B. Additional Bonus and Offer-Specific Terms

Sam’s Club may, from time to time, offer bonuses, promotions, or other opportunities to earn Sam’s Cash. Such offers may, in the sole discretion of Sam’s Club, be made available to only certain members. Such offers may be subject to additional terms, presented with the offer (such as a start date and deadline, excluded dates, or -per-transaction maximum reward), and are subject to change at any time without notice.

1. Card-Linked Offers

A participating third-party merchant may make available the opportunity to earn Sam’s Cash when you use your Designated Payment Card to make a purchase from that merchant (“Card-Linked Offer”). For some Card-Linked Offers, you will automatically earn Sam’s Cash when you use your Designated Payment Card to make a qualifying purchase from the participating merchant. For other Card-Linked Offers, you must first activate the offer and then use your Designated Payment Card to make a qualifying purchase from the participating merchant in order to earn Sam’s Cash. For select Card-Linked Offers, activation is required prior to each purchase, and the offer must remain activated at the time of purchase. For those select Card-Linked Offers, you must reactivate an offer before you can redeem it again.

For other Card-Linked Offers, you may also have the opportunity to increase the amount of Sam’s Cash earned by activating the higher earn rate (that is, clicking on “Increase”) for the offer before using your Designated Payment Card to make a qualifying purchase from the participating merchant. Participating merchants may make additional Card-Linked Offers available. Any terms or conditions associated with a Card-Linked Offer (such as a start date and deadline, excluded dates, activation requirement, per-transaction maximum reward, or qualifying activities) will be presented to you together with the offer itself.

2. Bonus Offer Promotions

Sam’s Club, from time to time, may elect to offer various types of Bonus Offer promotions for members (“Bonus Offer Promotions”). For example, if you are a Sam’s Club Plus member and are eligible to participate in the Sam’s Cash Bonus Offers Program, Sam’s Club may, from time to time, elect to offer you the opportunity to receive additional rewards or bonuses, which may include offers like an additional Sam’s Cash reward equal to 20% of your Sam’s Cash earnings for each qualifying activity you complete. In that example, if you complete a qualifying activity that earns $10 in Sam’s Cash and you are an eligible Sam’s Club Plus member and at the time of the transaction there is an active Bonus Offer Promotion for Plus members which offers a 20% bonus on earnings, you would earn an additional $2, for a total of $12 in Sam’s Cash earned. Sam’s Club is not obligated to provide Bonus Offer Promotions but may do so in its sole discretion. Bonus Offer Promotions may be terminated, removed, or modified at any time for any reason at Sam’s Club’s sole discretion without any notice. V. Release of Liability

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, SAM’S CLUB AND ITS AFFILIATES, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS (INCLUDING PAYMENT CARD NETWORKS SUCH AS VISA, MASTERCARD, AND AMERICAN EXPRESS AND PAYMENT PROCESSORS) EXPRESSLY DISCLAIM ANY WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SAM’S CLUB AND ITS AFFILIATES, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS (INCLUDING PAYMENT CARD NETWORKS AND PAYMENT PROCESSORS) DO NOT WARRANT THE DATA, CONTENT, ANALYTICS, FEATURES, OR INFORMATION PROVIDED THROUGH THE SAM’S CASH BONUS OFFERS PROGRAM, INCLUDING WITHOUT LIMITATION TRANSACTION DATA OR USER SUBMISSIONS OR OTHER DATA PROVIDED BY OTHER USERS, TO BE UNINTERRUPTED, ACCURATE, USEFUL, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS.

UNDER NO CIRCUMSTANCES WILL SAM’S CLUB OR ITS OFFICERS, DIRECTORS, AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, OR OTHER REPRESENTATIVES, THIRD-PARTY SUPPLIERS OR SERVICE PROVIDERS (INCLUDING PAYMENT CARD NETWORKS AND PAYMENT PROCESSORS) BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, RELIANCE, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY LOSSES OR DAMAGES OF ANY KIND ARISING FROM OR RELATED TO THE SAM’S CASH BONUS OFFERS PROGRAM, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF SAM’S CLUB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PROVIDED BY APPLICABLE LAW, THIS DISCLAIMER APPLIES TO ANY DAMAGES OR INJURY ARISING FROM ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECTS, DELAY IN OPERATION OR TRANSMISSION, LOST PROFITS, LOSS OF GOODWILL, LOSS OF DATA, WORK STOPPAGE, ACCURACY OF RESULTS, COMPUTER FAILURE OR MALFUNCTION, COMPUTER VIRUSES, FILE CORRUPTION, COMMUNICATION FAILURE, NETWORK OR SYSTEM OUTAGE, THEFT, DESTRUCTION, UNAUTHORIZED ACCESS TO, ALTERATION OF, LOSS OF USE OF ANY RECORD OR DATA, AND ANY OTHER TANGIBLE OR INTANGIBLE LOSS.

IN NO EVENT WILL SAM’S CLUB OR ITS AFFILIATES’, CONTRACTORS’, EMPLOYEES’, AGENTS’, SUPPLIERS’, OR SERVICE PROVIDERS’ (INCLUDING PAYMENT CARD NETWORKS’ AND PAYMENT PROCESSORS’) TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS OR YOUR USE OF THE SAM’S CASH BONUS OFFERS PROGRAM (WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, WARRANTY, OR OTHERWISE) EXCEED [$10.00 USD].

VI. Changes and Termination

Your Designated Payment Card will remain linked in the Sam’s Cash Bonus Offers Program unless and until you unlink it from the Sam’s Cash Bonus Offers Program or cancel your Sam’s Club membership. You can unlink your Designated Payment Card at SamsClub.com/BonusOffers. To do so, click on your name, click on Your Cards, click on Unlink and confirm, when prompted, that you want to unlink the card from your account. You may contact the Sam’s Club customer service center at SamsClub.com/Help if you have questions. If you cancel your Sam’s Club membership or allow it to lapse, you will continue to earn Sam’s Cash from previously activated offers or offers which do not require activation for 60 days from date of cancellation or expiration of membership, but you will not be able to access your earnings unless you renew your Sam’s Club membership. If you do not renew your membership within 60 days, your Designated Payment Card(s) will be unlinked from the Platform, and you will be unable to further participate in the Sam’s Cash Bonus Offers Program until you reactivate your membership. If your Sam’s Club membership is terminated or revoked, your Designated Payment Cards will be unlinked from the Platform, and you will no longer be eligible to participate in the Sam’s Cash Bonus Offers Program.

Sam’s Club reserves the right to amend, terminate, cancel, or temporarily suspend the Sam’s Cash Bonus Offers Program or any offer, any product within an offer, Bonus Offers Promotions, or other bonus made available through the program, in whole or in part, or change any of these Sam’s Cash Bonus Offers Program Terms and Conditions at any time for any or no reason and without notice to you. Sam’s Club further reserves the right to suspend or terminate your access to the Sam’s Cash Bonus Offers Program, to remove Sam’s Cash from your account or from your payment methods, and/or to place a hold on Sam’s Cash in your account or in your payment methods, as set forth in these Terms and Conditions, in the event of fraud, abuse of the Sam’s Cash Bonus Offers Program, or violation of these Terms and Conditions, the SamsClub.com Terms and Conditions, the Clubs, Site and Membership Terms of Use, the Sam’s Cash Loyalty Rewards Program Terms and Conditions, the Sam’s Club Mastercard Terms and Conditions, or other applicable Sam’s Club rules, in each case as determined by Sam’s Club in its sole discretion and without notice to you. Such action may result in the forfeiture of Sam’s Cash earned but not yet redeemed.
